Southcourt Property is a trading name of Southcourt Property Services Ltd which is a Limited Company registered in England whose registered number is 08108696 and registered office is Kemp House, 152 City Road, London EC1V 2NX.

2. Right to Refuse
Southcourt Property Services reserves the right to refuse to accept any order received from any person/s or organisation.
3. Permitted Use
All material, information and services supplied may be used solely by the purchaser in connection with their own estate agency or letting agency business. For purchasers of our Professional or Platinum package we will provide free software, hosting and support for the period agreed at the time of purchase and advertised at that time on our website. At the end of any included service period, a competitive monthly fee as shown in force on our website at the time of purchase will be payable for our web hosting, email services and cloud based software. In the event that you wish to cancel your web hosting and related services as above at any time and for any reason, you may do so at any time with 1 month’s notice with no further hosting payment obligation.
4. Confidentiality Agreement
The purchaser agrees to keep confidential and not disclose to any person/s or organisation outside of their immediate business all information, efficient working methods, advanced marketing techniques, trade secrets and systems, procedures and processes, that are learned through the operating manual, documentation, software, support, update services, and referral network supplied. No part may at any time be sold, resold, gifted, passed on, transferred, licenced, or possession parted with in any way to any other person/s or organisation without the express written permission of Southcourt Property Services Ltd.
5. Separate Entity
The purchaser’s business is a separate legal entity to Southcourt Property Services Ltd and the trading name must not include the word ‘Southcourt’.
Whilst all best efforts have been made to ensure that the materials, information and services that we provide are accurate and in accordance with current law, the purchaser acknowledges that Southcourt Property Services Ltd, its employees and associates are not solicitors nor legally qualified, and that none of the materials, information and services that we provide constitute legal advice and therefore should not be acted or relied upon prior to consulting your own solicitor or qualified legal advisor. In accepting these terms and conditions, you acknowledge that you run your business at your own risk.
Although best efforts have been made to ensure that all materials, information and training provided in our Business Packages, training and support is suitable, sufficient and accurate in accordance with current English law, the purchaser recognises that the UK government may change legislation at any point in the future. We provide expert updates and support for new start-up agents within our Members Area to enable agents to stay informed of any changes to legislation on a best endeavours basis. The purchaser agrees that Southcourt Property Services Ltd cannot be held liable under any circumstances for any losses as a direct or indirect result of any material or training provided or any changes in legislative requirements after becoming a client. The purchaser also agrees that under no circumstances shall Southcourt Property Services Ltd be liable for any direct, indirect, special, consequential or punitive damages that result from, or in any way arise out of, the availability, use, reliance on, or inability to use the materials in this site, even if Southcourt Property Services Ltd has been advised of the possibility of such damages, and regardless of the form of action, whether in contract, tort, or otherwise.
9. No Liability for Third Parties
Southcourt Property Services Ltd makes no warranty as to the usability, reliability, suitability or continuation of service of any product or service provided by any third party, individual or company that we may include, introduce or recommend with or in connection with our Complete Business Package or Property Website Package. The customer accepts this as fair and exonerates Southcourt Property Services Ltd in the event of any complaint or legal action.
10. Legal Jurisdiction
Legal action may be taken against any person/s who infringe/s these Terms and Conditions. To the extent possible under applicable law, these Terms and Conditions shall be governed by the laws of England and shall be subject to the non-exclusive jurisdiction of the English courts.
11. Website, EMail and SouthcourtHub Software Package
Where we provide professional website, business email and cloud based software services and Apps, we provide 6 months free hosting of your website, and our hosting, email and cloud software services are subject to our Digital Services Subscription. To help our clients cashflow during the start up phase, this is provided on a very low cost basis for new start up clients for SouthcourtHub cloud software, ultra-fast website hosting and unlimited business-class email addresses. This may be paid monthly, annually (at a discounted rate) or multi-annually (at a heavily discounted rate).
12. Uptime and Provision of Services
We aim to attain 99.999% uptime on our website, email and cloud software services, however in the event that due to technical reasons we are unable to provide email, website or software services, the client accepts that these services are provided on a reasonable endeavours basis only. If you wish to close your website hosting account, and transfer your email and website elsewhere, you may do so at any time using the export facilities provided within your website Control Panel.
